Course aims
¤ To create a coherent overview and establish the capability to get one’s bearings in the area of Public Law with an emphasis on Constitutional Law, Administrative Law, European Union Law, Criminal Law, and Procedural Law;
¤ To develop legal-theoretical analytical skills in Public Law;
¤ To provide knowledge and skills to enable the student to present and defend his position on a given issue in Public Law and the ability to analyze uncomplicated legal issues and cases.
Brief description of the course
In this subject the student will learn the theory of how to differentiate between public law and private law, the basic principles of constitutional law, the central issues constitutional law and administrative law. The student will acquire on overview of the basic constitutional rights, freedoms and responsibilities of individuals. The student will acquire the basic understandings and content of European Union Law, penal law and procedure (including criminal acts, the elements of crime, specific intent, premeditated acts, general intent, different degrees of negligence, guilt, illegal acts, competence and incompetence, punishment, goals of punishment, statue of limitations, the presumption of innocence). An overview of the Estonian court system is given together including the principles and basic understandings of different categories of court proceedings (including civil, administrative, criminal, rural courts, administrative courts, regional (appellate) courts, the National Court, the complaint, the adversarial principle, the principles of investigation, the presumption of innocence, legal representative, legal defender).
Learning outcomes in the course
Upon completing the course the student:
A student who has successfully completed the course:
¤ has acquired an overview of the system of public law, has knowledge of the theory of how to distinguish between public law and private law;
¤ knows the position of public law within the legal system;
¤ knows the fundamentals of constitutional law, administrative law, European Union Law, criminal law and procedure, also know the principles of the public law;
¤ knows how to use and apply the basic knowledge of public law to analyze legal issues and cases.
