Course aims
- To create opportunities for the student to be able to analyze current difficult and complex problems dealing with international law, including the use of force by state and non-state actors, issues of state sovereignty and self-determination;
- to facilitate the acquisition of good knowledge on legal matters of the implementation of state sovereignty and self determination
- Be able to differentiate the status and legal regime of maritime areas and parts of seabed, knowledgeable of jurisdiction, all procedures of activities at the International Tribunal for the Law of the Sea.
Brief description of the course
The course deals with the nature and characteristics of international law as it relates to issues of state sovereignty, self-determination, statehood; the use of force and the right of self-defence, collective security, humanitarian intervention.

The course deals with the contemporary division of ocean into maritime areas with different legal status and regime. Arctic Ocean: whether sectored or division of it according to the principles and norms of the UNCLOS. International Tribunal for the Law of the Sea in Hamburg and settlement of disputes between the States. Prompt release procedure of detained foreign vessels and crew. Arrest of ships: maritime claims and liens.
Learning outcomes in the course
Upon completing the course the student:
- has ability to understand and analyze issues of state sovereignty;
- has ability to understand and analyze the use of force by states in different circumstances;
- knows the contemporary system of maritime zones and seabed, legal status and regime of those and prescribes basic rights and duties of the coastal States, flag States, port States as well as users of the seas; ability to feel the aspirations and possibilities of Arctic States related to the possibility of global warming;
- has general understanding on settlement of disputes between States and especially in matters of the law of the sea at ITLOS;
- knows this speedy and specific procedure at ITLOS as the main activity of this court and is able to explain those prompt release procedures (among first 12 judgments);
- has ability to know the procedure of arrest of ships as well as maritime claims and maritime liens.
