Course aims
The aim of the course is to provide students with a broad understanding of the different legal systems that exist globally; their historical backgrounds; sources of law and major legal institutions, as well as an understanding of the convergence of international, civil and common law in the modern era of globalization. The course also considers selected topics in private and public law, comparing how different legal systems approach similar issues.
Brief description of the course
This course covers the two principal legal systems in the world —common law and civil law with some exposure to the Islamic and Asian traditions and European Union law. Students will study the historical evolution of these traditions from a comparative perspective. This course will compare the underlying legal philosophies of different legal systems through the analysis of the sources of law, judicial process and judicial review through learning constitutional law, contracts, and criminal and civil procedure.
Learning outcomes in the course
Upon completing the course the student:
- understands of how different legal systems approach similar legal issues;
- will be able to find and use sources of law of different countries to resolve basic practical cases;
- understands of how procedural rules differ in different legal systems;
- knows how the court system functions in different legal systems.
